Unfortunately, the state of Arizona has laws excluding residents from participating in certain competitions.

Thanks for another inspiring competition! I hope I have time to come up with something.

I know the “US only” restriction is frustrating to a lot of members, but it’s not completely BurdaStyle’s fault. They’re restricted by a lot of rules from countries, the companies contributing prizes, and even state laws. (that said, I think it has been quite a while since we’ve seen a competition for other countries)

I live in Canada and I have to say I’m rather disappointed that I can’t enter either. It’s uncommon to find contests that can’t run in Canada too, perhaps they’ll start a tradition and include other countries next time :)

I was so excited when I read about this contest. I even had the ideal outfit ( bought yesterday from 2nd hand store) that just begs to have something done to it..

Then I read the entry details. US only. Sob!. What about Australia?. Project Runway is shown world wide so its a great pity that the contests aren’t world wide too.

May I use an existing pattern to make something or do I need to make my own? Also, how much extra fabric can be used? Is a yard too much if it is a jacket/pant outfit?

You can definitely use an existing pattern to refashion your existing piece. No rules on extra fabric either. I can’t wait to see your submission!

Say what?? "who are located in and legal residents of the United States (excluding Arizona) " What are they trying to say…we’re not legal U.S. citizens here in AZ or that we’re not considered part of the United States. Oh…this has to do with SB1070 doesn’t it? Ok…that’s cool. Punish the citizens here. By the way, we didn’t vote for that law. I’m sorry but I just find it interesting that AZ is the only state singled out as not eligible under the “legal residents” clause in the rules.

I am in Arizona..and have entered many contests..I have lived here for over 30 years and have never heard of the “law” you refer too, or been told we are excluded because of such a law…can you give me more specific info about this law? I can’t believe our state is excluded from competing! That is really unfair. I would really like to check into this more. Thanks!

      Best as I can figure:

13-3311. Amusement gambling intellectual contests or events; registration; filing of rules; sworn statement; exceptions

      A. Before any person conducts an amusement gambling intellectual contest or event pursuant to section 13-3301, paragraph 1, subdivision (d), item (iii), the person shall register with the attorney general’s office. The registration shall include:

      1. The name and address of the person conducting the contest or event.

      2. The minimum dollar amount of all prizes to be awarded.

      3. The duration of the event.

      4. The statutory agent or person authorized to accept service of process in Arizona for the person conducting the contest or event.

      5. All rules governing the contest or event, including the rules applicable in case of a tie.

      6. The name and description of the product and the established purchase price for the product.

      B. Within ten days following the award of all prizes in connection with an amusement gambling intellectual contest or event, the person conducting the contest or event shall file with the attorney general’s office the names and addresses of all persons who have won prizes in connection with the contest or event.

      C. For each amusement gambling intellectual contest or event held, the person conducting the event shall file with the attorney general’s office a sworn statement under oath that no increment has been added to the established purchase price for the product in connection with the gambling event.

      D. This section does not apply to organizations that have qualified for an exemption from taxation of income under section 43-1201, paragraph 1, 2, 4, 5, 6, 7, 10 or 11.

I just had a very interesting conversation with Arizona’s Attorney Generals office, and the state law library regarding this contest, and the specific “exclusion” of Arizona residents. There is NO law that forbids us to participate in your contest. Would your attorneys like to disclose their reasons for excluding our residents? This is not a lottery, gambling, raffle, nor are you required to purchase anything to participate in the contest, correct? Those would be the only reasons to exclude us, and the only laws on the books. Do I need to prove I am a LEGAL resident?..not a problem..I am a proud citizen of the US and of the state of AZ.

I’d even be fine with it if there was such a law here in AZ, but they have no legit reason to exclude Arizona. Other states, like Florida, have much stricter rules than we do, yet they are allowed to participate. It is also very suspicious they have refused to respond to my investigation into why they were excluding us. If we submitted anyways as a legal citizen of the US, with no legal standing to be excluded would that not be discrimination? hmmm class action lawsuit anyone?

Like a couple of others asked, I am also wondering if the remake had to be done in a specific time frame, like in the past 2 weeks? Or can we submit something that was done earlier? I did a project in February, took before and afters, and even used my Rowenta iron! Can I submit it? TIA

Sweepstakes and contests are two promotional tools that can increase brand awareness, however, there are many federal, state and local laws and regulations governing sweepstakes and contests. For some, it is difficult to understand the difference between the two. As a general rule, a sweepstakes or contest becomes a “lottery” and, thus, illegal under federal and state laws, if all of the following three elements are present:

Prize – A prize is always present in such promotions.

Consideration – Consideration generally means that the entrant has to make a purchase or payment (e.g., buy the product) or in some states do something substantial (e.g., go to the store to get or deposit the entry form).

Chance – A chance means that the winner is selected at random (e.g., a drawing, a pre-selected number, a rub-off card randomly distributed, etc.). The distinction between a sweepstakes and a contest is that in a sweepstakes the element of consideration must be eliminated because the winner is selected by chance; the entrant does not have to pay or do anything substantial to enter. In a contest, the element of chance is eliminated; the winner is selected on the basis of skill. In a contest, it is permissible to require a purchase in order to enter except in certain states. With respect to sweepstakes, the laws and interpretations among the different states as to what constitutes consideration are highly uncertain and frequently changed. With respect to contests, similar controversy exists as to what constitutes “skill.” All sweepstakes and contests should be accompanied by official rules, which are clear and unambiguous. Disclosures required in advertising a sweepstakes or contest will vary depending on the nature of the promotion and the state in which it is running. Special care should be taken that advertising of the promotion is consistent with the rules. It should also be noted that the States of Florida and New York require that most sweepstakes be registered with the state and that a deposit be made or bond posted to cover the value of the prizes. Rhode Island requires registration of sweepstakes in which local retail stores are involved. Arizona requires registration of skill contests.

If you are replying to me, then why does the state of ARIZONAS ATTORNEY GENERAL and THE STATE LAW DEPARTMENT both, say there is not such a law rule, or regulation in AZ keeping us from competing in the contest, based on what is printed above as the rules, etc, yet we are excluded? I finally got an email response from Burda, that once again gives NO specific reason for exclusion to Arizona residents, and once again, blames it on their law department, and once again the actual question is vague and not answered!!!! Very fishey.

I have a proposition; why not make a European burdastyle website. There is a lot of people from Europe who would be interested in a contests like this or similar, or maybe have contests only for European, cause I’m feeling like this side of the world is a little bit deprived.
